ELIGIBILITY: The Kick for a Kia Sweepstakes (the “Sweepstakes”) is open only to individuals who, as of the time and date of entry: (i) are legal residents of the State of Georgia; (ii) are at least twenty-one (21) years of age; (iii) have a current and valid driver’s license and proof of car insurance; (iv) are not current or former professional or semi-professional soccer/football players (who played a position involving kicking) or coaches, or current or former collegiate or high school soccer/football players or coaches who have played/coached at the collegiate or high school level in the previous five (5) years (includes Freshman, Junior Varsity and Varsity for both men’s and women’s teams); and (v) have not won a prize from a Comcast Cable Communications Management, LLC, d/b/a Comcast Advertising (“Comcast Advertising”) promotion within the past six (6) months, measured from the Sweepstakes Period (defined below) start date and have not been grand prize winners of the Kick for a Kia Sweepstakes in any previous year. Employees, officers and directors, their immediate families (i.e., spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren, regardless of where they reside), and those living in the same household (i.e., those who share the same residence at least three (3) months a year, whether or not legally related), of Comcast Advertising, Kia America, Inc. (“PBI”), and Atlanta Hall Management, d/b/a The College Football Hall of Fame (“HOF”) (each, a “Sponsor” and collectively, the “Sponsors”), and each of their respective parents, affiliates, subsidiaries, prize providers and advertising and promotion agencies (collectively, “Sweepstakes Entities”), are not eligible to enter the Sweepstakes or win a prize. By participating, entrants agree to be bound by these “Official Rules” and the decisions of the judges and/or Sponsors, which are binding and final on matters relating to this Sweepstakes.
ENTRY PERIOD: The Sweepstakes begins at 12:01 a.m. Eastern Time (“ET”) on July 3, 2026 and ends at 11:59 p.m. ET on August 21, 2026 (the “Sweepstakes Period”). Sponsors’ designated computer shall be the official timekeeper for this Sweepstakes.
METHOD OF ENTRY: To enter the Sweepstakes, during the Sweepstakes Period, visit TheBigCarKickOff.com, complete all required information and follow all instructions to submit the official entry form. The official entry form may include, among other things, the entrant’s full name, physical address (no P.O. Boxes), email address and other related registration information as prompted. Entrants must complete and submit the entry form with all required information for the entry to be eligible.
Limit of one (1) entry per person/email address per calendar day during the Sweepstakes Period, for a total maximum of forty-nine (49) entries per person/email address permitted in this Sweepstakes. Each “calendar day” shall begin at 12:01 a.m. ET and conclude at 11:59 p.m. ET. All entries must be received during the Sweepstakes Period to be eligible. Entries generated by script, macro or other automated means are void. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsors’ sole and absolute discretion. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Those who do not follow all the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Sponsors may be disqualified. All entries become the property of Sponsors and may not be acknowledged or returned. All entrants submitting materials/content as part of the Sweepstakes will shall be non-exclusively licensing (with the unlimited right to sublicense) to Sweepstakes Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof. Entrants represent and warrant that the materials submitted will not infringe or violate any right whatsoever, including, without limitation, any personal rights (e.g., defamation, privacy, false light, moral right, etc.) or any property rights (e.g., copyright, trademark, right to ideas, etc.) of any person or entity and the use thereof will result in no third party liability or obligations. The Sweepstakes Entities may run multiple campaigns, contests, sweepstakes or other promotions simultaneously. Entry into one (1) campaign, contest or sweepstakes does not constitute entry into any other.
DRAWING & WINNER NOTIFICATION/ODDS: Potential First Prize (defined below) winners will be selected in a random drawing on or about August 22, 2026, from all eligible entries received. Odds of winning a First Prize depend on the total number of eligible entries received. Odds of winning the Grand Prize (defined below) depend on each participant’s field goal kicking skills when participating in the kicking competition. Potential winners will be notified by phone, mail and/or email in a commercially reasonably time after the drawing and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release (collectively, the “Affidavit”), within three (3) days of date of issuance. Notification is deemed to have occurred immediately upon the sending of an email or placing of a phone call, one (1) day after sending via a delivery service or two (2) days after mailing. A potential prize winner who provides a P.O. Box may be required to provide an alternative address and this may cause a delay in notification and acceptance so use of a P.O. Box is discouraged. If the Affidavit is not returned within the specified time period, prize or prize notification is returned as undeliverable, potential winner is not in compliance with these Official Rules, or Sponsors are unable to reach a potential winner within a reasonable time period, the prize will be forfeited and, at Sponsors’ discretion, an alternate winner selected. Decisions of the Sponsors as to the selection of the winners will be final. The Sweepstakes Entities are not responsible for false, incorrect, changed, incomplete or illegible contact information. The Sweepstakes Entities are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email account to receive email messages. The Sweepstakes Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners. If any potential prize winner is found to be ineligible, if they have not complied with these Official Rules, or if they cannot attend or participate in any portion of the prize or decline a prize for any reason prior to award, such potential winner may be disqualified and an alternate potential winner may be selected.
SEVENTEEN (17) FIRST PRIZES: Seventeen (17) first prize winners (collectively, “First Prize Winners”) will each receive: Two (2) passes to visit the College Football Hall of Fame, currently scheduled to take place at approximately 10:30 a.m. ET on Thursday, September 3, 2026 at 250 Marietta St. N.W., Atlanta, GA 30313; and two (2) tickets to attend the 2026 Aflac College Football Kickoff Game (the “Aflac Kickoff Game”), currently scheduled to take place on Saturday, September 5, 2026 at the Mercedes Benz Stadium, 1 Northside Drive N.W., Atlanta, GA 30314 (collectively, the “First Prize”). First Prize Winners must participate in the field goal kicking competition on September 3, 2026 at the College Football Hall of Fame, and, if such First Prize Winner advances, on September 5, 2026 at the Aflac Kickoff Game, as described below, otherwise the First Prize Winner will forfeit the First Prize. Approximate retail value (“ARV”) of the First Prize is four hundred ninety dollars ($490). Any/all transportation to/from the Aflac Kickoff Game will not be provided and will be each First Prize Winner’s sole responsibility. The total ARV of all First Prizes awarded in this Sweepstakes is eight thousand three hundred and thirty dollars ($8,330). Sponsors will deliver the First Prizes physically or electronically as communicated to First Prize Winners. First Prize Winners may be required to create an account on a third-party website or ticketing platform in order to receive their tickets, as communicated by Sponsors; creating an account on such third-party website or ticketing platform is free.
First Prize Winners are solely responsible for all expenses, costs and/or fees associated with acceptance and/or use of the First Prize not specified herein as being awarded, including, without limitation, any and all parking fees and taxes. Tickets and passes are subject to certain terms and conditions as specified thereon. Seat locations at the Aflac Kickoff Game will be determined by Sponsors. First Prize Winners and guests must comply with all venue rules and regulations. Failure to do so may result in forfeiture of the prize, or any element thereof. In the event that the Aflac Kickoff Game is postponed, tickets will be awarded for the postponed date (if the game is rescheduled). In the event the Aflac Kickoff Game is cancelled, Sponsors will provide a prize of comparable or greater value. The First Prize Winners are strictly prohibited from selling, auctioning, trading or otherwise transferring the tickets unless Sponsors consent is obtained in writing. First Prize Winners may not substitute, assign or transfer any element of the First Prize, but Sponsors reserve the right, at their sole discretion, to substitute the First Prize or any element thereof with one of comparable or greater value. First Prizes are awarded “as is” with no warranty or guarantee, whether express or implied. All First Prize details are at Sponsors’ sole discretion. In the event a First Prize Winner (and/or their guests) engages in behavior that (as determined by Sponsors or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsors reserve the right to terminate the applicable experience early. Decisions regarding the conduct of the First Prize Winners and guests in all aspects of their participation in the First Prize event/activity will be in the sole discretion of Sponsors, and any of Sponsors’ representatives and final and binding in all respects. First Prize Winners and guests may be removed or disqualified from participating in any aspect of the First Prize for any reason at any time, including, without limitation, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, creating the potential for injury or property damages, or for any unhealthy, unsafe, unlawful, or inappropriate act. If a First Prize Winner or guest who, in the opinion of Sponsors or any of Sponsors’ representatives, is considered a physical or mental threat to the well-being of any other individual, they may be removed from any premises relating to the First Prize and First Prize Winner consents to such removal. Each First Prize Winner and any permitted guest of such First Prize Winner must comply with all NCAA and Mercedes Benz Stadium rules and regulations. Failure to do so will result in forfeiture of the First Prize. The NCAA and Mercedes Benz Stadium reserve the right to remove or deny entry to a First Prize Winner and their guest who fail to comply with all NCAA and Mercedes Benz Stadium rules and regulations, engage in a non-sportsmanlike or disruptive manner, or act with intent to annoy, abuse, threaten, or harass any other person at the event. Limit of one (1) First Prize per person/email address/household.
First Prize Winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the First Prizes they receive, regardless of whether they, in whole or in part, are used. The Sweepstakes Entities are not responsible for and will not replace any lost, mutilated or stolen First Prizes or any First Prize that is undeliverable or does not reach a First Prize Winner because of an incorrect or changed address.
KICKING COMPETITIONS: The First Prize Winners will have an opportunity to participate in a field goal kicking competition to win the Grand Prize in accordance with this section. The First Prize Winners will have the opportunity to compete against each other in the field goal kicking competition at approximately 10:30 a.m. ET on Thursday, September 3, 2026 at the College Football Hall of Fame located at 250 Marietta St. N.W., Atlanta, GA 30313. First Prize Winners are responsible for their own transportation to attend the field goal kicking competition.
A field goal kicking competition is defined as kicking a football through the goal post uprights specified by Sponsors. First Prize Winners that choose to participate in the field goal kicking competition (the “Contestants”) must wear street shoes/sneakers and are not allowed to wear football kicking shoes or any other professional football shoe for any portion of the kicking competition. Contestants must participate in the field goal kicking competition themselves and will not be permitted to have any other person or individual participate in the field goal kicking competition on their behalf. Contestants will participate in three (3) rounds in the field goal kicking competition for a chance to win the Grand Prize. In Round 1 of the field goal kicking competition at the College Football Hall of Fame, Contestants will line up approximately fifteen (15) yards away from the goal posts (the balls will be spotted on the five (5) yard line) and attempt to kick each of the five (5) footballs provided to them through the uprights. Each Contestant will be assigned a number and each will attempt their five (5) kicks one right after the other. If no one gets any of the footballs through the uprights during Round 1, the game resets and keeps resetting until six (6) winners emerge. In the event of a tie during Round 1, the tied Contestants will each attempt to kick the most footballs through the uprights in sixty (60) seconds (the balls will be spotted and fielded for the participants on the five (5) yard line). A tie is defined by two (2) or more Contestants kicking the exact same number of footballs through the uprights during Round 1. The tie breaking process will continue until the winner emerges. The top six (6) participating Contestants who score the most field goals in Round 1 (or during the tiebreaking procedure) will then proceed to Round 2 of the field goal kicking competition. In Round 2 of the field goal kicking competition, the top six (6) Contestants from Round 1 will line up approximately twenty-five (25) yards away from the goal posts (the ball will be spotted on the fifteen (15) yard line) and attempt to kick as many footballs as possible from five (5) footballs provided to them through the uprights. If no one gets any of the footballs through the uprights during Round 2, the game resets and keeps resetting until one (1) winner emerges. In the event of a tie during Round 2, the tied Contestants, as determined by Sponsors in their sole discretion, will attempt to kick the most footballs through the uprights in sixty (60) seconds (the ball will be spotted on the fifteen (15) yard line and footballs will be fielded by the Contestants). The tie breaking process continues until the top one (1) winner emerges. In Round 3, the Contestant who scored the most field goals in Round 2 (the “Preliminary Kicking Competition Winner”) will then proceed to attempt a field goal at halftime of the Aflac Kickoff Game (or at another time specified by Sponsors at their discretion) on September 5, 2026 at the Mercedes Benz Stadium, 1 Northside Drive N.W., Atlanta, GA 30314. The Preliminary Kicking Competition Winner will line up at the fifteen (15) yard line of the football field to kick a field goal kick. A field goal kick is defined as a kicker making an attempt to kick the ball through the uprights. If the Preliminary Kicking Competition Winner makes the on-field field goal, they will be declared the potential Grand Prize winner (“Grand Prize Winner”), subject to verification of eligibility and compliance with these Official Rules. If the Preliminary Kicking Competition Winner misses the field goal kick, they will not receive the Grand Prize. All decisions and specifications related to the kicking competitions will be determined by Sponsors, in their sole discretion.
ONE (1) GRAND PRIZE: One (1) Grand Prize Winner from the field goal kicking competition, if they successfully make the field goal during the Aflac Kickoff Game as described above, shall receive the following: One (1) 2026 Kia K4 Hatchback GT-Line (the “Grand Prize”) with a Manufacturer’s Suggested Retail Price (“MSRP”) of twenty seven thousand eight hundred and twenty dollars ($27,820). The actual retail value and MSRP of the Grand Prize may vary. Any difference between the actual retail value and the stated MSRP will not be awarded. The Sponsors will endeavor to award the Grand Prize by November 30, 2026, but such date is not guaranteed. The Grand Prize includes a destination fee but excludes tax, title, license charges, and any document fees. For the Grand Prize Winner, the total ARV of the Grand Prize and the First Prize is twenty eight thousand three hundred ten dollars ($28,310). The total ARV for all seventeen (17) First Prizes and the one (1) Grand Prize is thirty six thousand one hundred and fifty dollars ($36,150).
The Grand Prize Winner must take delivery of the Grand Prize at the Ed Voyles Kia dealership located at 2145 Cobb Pkwy SE, Smyrna, GA 30080 (“Ed Voyles Kia”) within thirty (30) days after the date that Grand Prize Winner is notified that the Grand Prize has been delivered to Ed Voyles Kia, or the Grand Prize may (in Sponsors' sole discretion) may be automatically forfeited by such Grand Prize Winner. Sponsors will povide instructions to the Grand Prize Winner as to how to obtain their Grand Prize at Ed Voyles Kia. The Grand Prize Winner will be required to personally retrieve the Grand Prize vehicle, and the Grand Prize Winner is solely responsible for transportation and related costs for collecting the Grand Prize vehicle. Sponsors will use reasonable efforts, subject to the Grand Prize availability, to deliver the Grand Prize within ninety (90) days of receipt of the completed Grand Prize Affidavit. Sponsors are not responsible for delays in delivery. Vehicles shown in connection with this Sweepstakes may not be actual vehicles awarded, and the Grand Prize Winner does not have choice of color. All depictions of the Grand Prize in publicity/advertising are for illustrative purposes only. Any upgrades and options are at the sole expense of each Grand Prize Winner. Package, factory options, and other specifics to be determined by KUS, and are subject to availability. Grand Prize Winner must be a licensed driver and must present a current valid U.S. driver's license and submit proof of insurance prior to taking possession of the Grand Prize. Failure to show valid license and proof may result in Grand Prize forfeiture and at Sponsors’ sole discretion, Sponsors may award the Grand Prize to the runner-up. The Grand Prize Winner is responsible for all associated dealership fees including all title, license, insurance, registration, dealer preparation, applicable taxes or fees, destination and handling charges, and other fees associated with automobile, including any travel and transportation costs associated with collecting the Grand Prize. All other costs not specifically stated herein as being awarded are the responsibility of Grand Prize Winner. Except as stated in the manufacturer’s limited warranty for the vehicle, none of KUS or any other person associated with the manufacture, distribution, development and execution of this Sweepstakes and its prizes, or any of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents makes any warranties, representations or guarantees, express or implied, in fact or in law, relative to the use or enjoyment of the Grand Prize, including, without limitation, its quality, mechanical condition, merchantability or fitness for a particular purpose. Any and all guarantees and warranties for the Grand Prize are subject to the manufacturer’s terms and conditions, and the Grand Prize Winner agrees to look solely to such manufacturers for any such warranty or guarantee claim.
The ARV of all prizes awarded in this Sweepstakes is based on available information provided to Sponsors and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The First Prize Winners and Grand Prize Winner may be required to provide Sponsors with a valid Social Security number before the prize will be awarded for tax reporting purposes. An Internal Revenue Service (“IRS”) Form 1099 may be issued in the name of each First Prize Winner and Grand Prize Winner for the actual value of the prize received. Unclaimed prizes will be forfeited. Prizes, if legitimately claimed, will be awarded. If a First Prize Winner or Grand Prize Winner does not accept or use the entire prize (as applicable), the unaccepted or unused part of the prize will be forfeited, and the Sweepstakes Entities will have no further obligation with respect to that prize or portion of the prize. No more than the stated prizes will be awarded.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries or emails; or for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with administration of the Sweepstakes, processing of entries, contacting the potential winners, announcement of prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of any Sweepstakes-related website. Persons who tamper with or abuse any aspect of the Sweepstakes, including any Sweepstakes-related website, or who are in violation of these Official Rules, as solely determined by Sponsors, may be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsors’ sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsors, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsors reserve the right at their sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at their discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken. Entrants, by participating, agree that Sponsors, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be indemnified and held harmless by entrants against, any liability for any injuries, losses or damages of any kind, including death or damage to persons or property resulting, in whole or in part, directly or indirectly, from: (i) acceptance, possession, misuse or use of any prize; (ii) participation in this Sweepstakes (including travel to/from any Sweepstakes or prize-related activity); (iii) the Released Parties’ actual or alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or claims of infringement of intellectual property; and (iv) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or prize. Each First Prize Winner and Grand Prize Winner, by acceptance of their prize, except where legally prohibited, grants permission for Sponsors and their respective designees to use the winner’s name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes, without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice, review or approval. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized account subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. “Authorized account subscriber” is the natural person who is assigned the email address by the ISP, online service provider, or other organization responsible for assigning email addresses. The invalidity or unenforceability of any provision of these Official Rules or the Affidavit shall not affect the validity or enforceability of any other provision. If any provisions of these Official Rules or the Affidavit are determined to be invalid or otherwise unenforceable, the other provisions therein shall remain in effect and these Official Rules/the Affidavit shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. In the event Sponsors are prevented from continuing with the Sweepstakes by any event beyond their control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsors’ control (each, a “Force Majeure” event or occurrence), Sponsors shall have the right to modify, suspend or terminate the Sweepstakes or prize. Sponsors additionally reserve the right, in their sole and absolute discretion: (a) to modify, suspend or terminate the Sweepstakes should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security or proper play of the Sweepstakes; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Sweepstakes; (ii) acting in violation of these Official Rules; (iii) acting in an un-sportsmanlike manner; or (iv) obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DAMAGE ANY SWEEPSTAKES-RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS MAY DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
ARBITRATION AND LIMITATION OF LIABILITY: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that: (i) any and all disputes and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and held at the AAA regional office nearest the participant; (ii) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (iii) judgment upon such arbitration award may be entered in any court having jurisdiction. BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and the rights and obligations of participant and Sponsors in connection with the Sweepstakes shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
ENTRY INFORMATION AND SWEEPSTAKES COMMUNICATIONS: As a condition of entering the Sweepstakes, each entrant gives consent for certain Sponsors to send to entrants information about Sponsors’ products and offers in accordance with the following Sponsors’ privacy policies (available at https://www.kia.com/us/en/content/privacy-and-legal/privacy-policy and https://www.xfinity.com/corporate/legal/privacystatement), to deliver their name, address and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules. Any information entrant provides in connection with this Sweepstakes may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winners’ list.

Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on any website, social media platform or application and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsors’ sole and absolute discretion.
